Supplemental Security Income for Children Attorney in Cook and Lake Counties
Illinois SSI Disability Lawyer for Children
Although children have typically never worked or paid into the system, Supplemental Security Income (SSI) can still be made available to them if they meet strict medical and financial requirements. A child under the Social Security Administration (SSA) regulations is defined as an unmarried individual who is not the head of his or her household and, is under the age of 18 or under the age of 22 and is a student (as determined by SSA).
The Social Security Administration determines whether a child qualifies for Supplemental Security Income based on similar criteria as Social Security Disability Insurance (SSDI): age, education, medical condition, and prior work experience. Since children have typically never worked at a job before, a judge will look at functional equivalence. If you meet all four criteria, you will then be found to be medically disabled. If you meet the financial criteria as well, then SSA will award the child SSI disability benefits. The maximum allowance from SSI depends on the Federal benefit rate. For 2019, the maximum for an individual is $771 and $1,157 for a couple. While the benefit amount can be smaller for SSI than SSDI, children can often get Medicaid to go along with their SSI payments to help with medical bills.
